Terms and Conditions for Warranty Claims for Used Vehicles
By purchasing a vehicle from Carnation Cars Ltd, you the "Buyer" agree to the following terms and conditions regarding warranty claims:
1. Warranty Coverage
1.1. The vehicle is sold with a limited used vehicle warranty, the duration of which is clearly stated on the sales receipt.
1.2. The warranty only covers major mechanical components such as engine and gearbox, subject to the terms outlined below.
1.3. The warranty does NOT cover:
Wear and tear items (e.g. tyres, brakes, clutches, exhaust systems, suspension components).
Electrical faults or warning lights unless otherwise stated in writing at the time of sale.
Batteries, fuses, bulbs, wipers, and fluids.
Interior fittings, trim, or bodywork.
Air conditioning or infotainment systems.
Damage caused by environmental factors, misuse, or poor maintenance.
2. Warranty Conditions
2.1. The warranty will be automatically void if:
Any work or diagnosis is carried out on the vehicle by a third-party mechanic or garage prior to notifying us and obtaining written authorisation.
The Buyer modifies, tampers with, or disassembles any mechanical components.
The vehicle is used for racing, towing, or commercial use (e.g. taxis, delivery services), unless specifically authorised in writing.
The vehicle is overloaded, misused, or not maintained in accordance with the manufacturer’s guidelines.
Fluids (oil, coolant, etc.) are not maintained at proper levels, resulting in engine or mechanical failure.
3. Diagnosis and Claims Procedure
3.1. The Buyer must contact Carnation Cars Ltd immediately upon identifying a fault within the warranty period.
3.2. Any diagnosis or inspection of the engine or gearbox will only be carried out by our authorised mechanic. No exceptions.
3.3. If a fault is found to be valid and covered, repair or replacement will be at our sole discretion. No compensation or reimbursement will be provided for third-party repairs.
3.4. The Buyer must return the vehicle to our premises for inspection and repair. Recovery or transport costs are not covered under the warranty.
3.5. In cases where no fault is found, or the fault is not covered, the Buyer agrees to bear the diagnostic cost and any applicable storage or labour fees.
4. Limitations of Liability
4.1. This warranty is not transferable to any subsequent owner.
4.2. Under no circumstances shall Carnation Cars Ltd be liable for:
Loss of use, inconvenience, or alternative transport costs.
Consequential losses including lost earnings, missed appointments, or business disruptions.
Costs incurred due to delay in repair or parts availability.
4.3. The maximum liability under this warranty shall not exceed the original purchase price of the vehicle.
5. Buyer Responsibilities
5.1. The Buyer must:
Maintain the vehicle as per manufacturer guidelines.
Service the vehicle at recommended intervals and keep records of such services.
Report issues promptly and not delay or ignore early signs of mechanical failure.
5.2. Failure to adhere to these responsibilities will result in warranty invalidation.
6. Fraudulent or Misleading Claims
6.1. Any false or fraudulent claim will result in immediate cancellation of the warranty.
6.2. Carnation Cars Ltd reserves the right to pursue legal action or recovery of costs if any attempt is made to manipulate or deceive the warranty process.
7. No Refund or Replacement Policy
7.1. All vehicle sales are final. This warranty is for mechanical coverage only and does not constitute a return, refund, or exchange policy.
8. Entire Agreement
8.1. These terms constitute the entire agreement relating to warranty coverage. Any verbal statements or promises made by employees or agents that contradict these terms shall be deemed invalid.
9. Governing Law
9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, with proceedings to be held in a court local to London where possible.
